📋 Summary: We collect the information we need to operate our website, respond to inquiries, deliver marketing and web services to our clients, process transactions, support and improve our platforms, and conduct permitted marketing. We do not sell your data — ever. You can request access to, correction of, or deletion of your information at any time. 1. Overview
LeadsNearby ("LeadsNearby," "we," "our," or "us") operates the website located at https://www.leadsnearby.com (the "Site") and provides digital marketing, website design and development, managed hosting, search engine optimization, content production, lead generation, review management, call tracking, and marketing automation services (collectively, the "Services") to businesses across the United States.
This Privacy Policy explains how we collect, use, disclose, store, and protect information about you when you visit our Site, request a proposal or consultation, become a client, use our platforms, apply for a job with us, or otherwise interact with us.
By using our Site or Services, you agree to the collection and use of information as described in this policy. If you do not agree with these terms, please do not use our Site or Services.
2. Our Role: When We Are the Business, and When We Act for Our Clients
This distinction matters, so we want to be clear about it up front.
When we act for ourselves (data controller / "business"): This policy governs information we collect about our own website visitors, prospects, clients, client contacts, vendors, and job applicants. We decide how that information is used.
When we act for our clients (service provider / processor): In the course of delivering the Services, we host websites, manage forms and chat widgets, run call tracking, send text and email campaigns, and manage review requests on behalf of our clients. When an individual submits a form on a client's website or texts a client's business number, that information belongs to and is controlled by that client — not LeadsNearby. We process it only to perform services for that client, under contract, and we do not use it for our own purposes or sell it.
If you interacted with a business we support and want to exercise privacy rights over that information, please contact that business directly. If you're unsure who to contact, email privacy@leadsnearby.com and we'll route your request to the appropriate client.
Our processing of client-controlled data is governed by our client agreements and our Data Processing Addendum, which is available to clients on request.
3. SMS/MMS Program Terms and Privacy Notice
This section applies when you provide your mobile phone number to LeadsNearby and consent to receive text messages from us.
Program Description: You may receive customer-care, informational, account-notification, and marketing messages from LeadsNearby. Messages may include consultation and proposal follow-ups, appointment scheduling and reminders, project and campaign status updates, support and ticket notifications, account and billing notifications, service and maintenance alerts, review requests, and occasional offers or announcements.
Consent: By providing your mobile phone number and opting in, you authorize LeadsNearby to send text messages to that number using automated or non-automated technology. Consent to receive marketing text messages is not a condition of purchasing goods or services.
Message Frequency: Message frequency varies based on your requests, appointments, project activity, account activity, and promotional preferences.
Message and Data Rates: Message and data rates may apply.
How to Opt In: You may opt in by submitting our Contact Form, completing our consultation or demo request form, using the chat widget available on our website, providing verbal consent to a LeadsNearby representative, or initiating a text conversation with us where permitted. Each digital opt-in method presents an SMS disclosure before submission.
Opt-Out: Reply STOP at any time to unsubscribe. After you reply STOP, we may send one final confirmation message. You will not receive additional text messages unless you opt in again. Reply START to resubscribe where supported.

Mobile Information and Consent Privacy: SMS consent and mobile opt-in information will never be shared with third parties or affiliates for their own marketing or promotional purposes. We may share this information only with service providers that help us deliver text messages, manage consent, provide customer support, maintain records, prevent fraud, or comply with law. Those providers may use the information only to perform services on our behalf.
Changes to the Program: We may change or discontinue the SMS program, message types, sending number, or delivery method at any time. Material changes will be reflected in this policy or communicated as required by law.

4. Information We Collect
4.1 Information You Provide Directly
- Contact Information: Name, business name, job title, mailing address, phone number, and email address when you request a proposal, book a consultation, subscribe to our content, contact us, or become a client.
- Business & Account Information: Company details, industry, service area, marketing goals, budget range, existing vendor relationships, and similar information you share so we can scope and deliver the Services.
- Technical & Account Access Information: Domain registrar, DNS, hosting, analytics, advertising, CRM, and field-service platform details you provide so we can build, host, migrate, or manage your properties. Credentials are handled as described in Section 8.
- Content You Supply: Copy, images, logos, video, reviews, testimonials, project photos, and other materials you provide for use on your website or in your marketing.
- Payment & Billing Information: Billing contact, billing address, and payment details processed securely through our payment processor. We do not store full card numbers or full bank account numbers.
- Communications: Messages, texts, emails, chat conversations, support tickets, meeting recordings and transcripts, calls, and reviews you send us.
- Employment Applications: Resume, work history, portfolio, references, and related information if you apply for a job with us.
4.2 Information Collected Automatically
- Usage Data: Pages visited, links clicked, time spent on the Site, scroll and click activity, referring pages, and search terms that led you here.
- Device Information: IP address, browser type, operating system, screen size, language, and device identifiers.
- Server & Hosting Logs: Request logs, error logs, and security event logs generated by our hosting and firewall infrastructure.
- Cookies & Tracking Technologies: See Section 11 for details, including advertising pixels, analytics tags, and chat/session tools.
4.3 Call Recording and Communications Monitoring
We use call tracking and may record or transcribe inbound and outbound phone calls for quality assurance, training, lead verification, dispute resolution, and campaign attribution. Where required by law, you will hear a notice at the start of the call and may decline recording by ending the call and contacting us by email or through our Contact page instead. Chat conversations and support tickets are logged and retained. Meetings may be recorded or transcribed with notice to participants.
4.4 Information from Third Parties
- Marketing & Automation Platforms: Our marketing, messaging, and scheduling platform (Launch365) routes web chat, form submissions, and text and call inquiries to our team.
- Advertising & Analytics Providers: Aggregated and campaign-level data from providers such as Google Analytics, Google Ads, Google Search Console, and social advertising platforms.
- Google Business Profile: Reviews and review responses posted to our Google Business Profile.
- Business Data Providers: Publicly available and commercially available business contact and firmographic data used to identify and qualify prospective clients.
- Payment Processors: Transaction status, chargeback, and payment-method validity information.
- Referral Sources: Information provided by partners or existing clients who refer you to us.
5. How We Use Your Data
- To Deliver the Services: Scoping engagements, building and hosting websites, running campaigns, producing content, managing reviews and messaging, and supporting your account.
- To Respond to Inquiries: Preparing proposals, scheduling consultations, and answering questions.
- To Process Transactions: Invoicing, payment processing, collections, and account reconciliation.
- To Communicate With You: Appointment confirmations and reminders, project and campaign updates, service and maintenance notices, support responses, and administrative announcements.
- To Operate, Secure, and Improve Our Platforms: Diagnosing issues, monitoring performance, preventing abuse, and understanding which pages and offers are useful so we can improve our Site and Services.
- To Send Marketing (with consent): Promotional emails or texts about our services, events, case studies, or offers — only where you've opted in or where permitted by law. See Sections 3 and 10.
- To Evaluate Employment Applications: Reviewing candidates and managing our hiring process.
- To Meet Legal Obligations: Complying with applicable law, responding to lawful requests, preventing fraud, and enforcing our Terms.
We do not use client-controlled end-customer data (Section 2) for our own marketing.
6. Artificial Intelligence and Automated Processing
We use artificial intelligence and automation tools to help draft content, analyze marketing performance, summarize communications, triage support requests, and generate reports. Where AI tools process personal information, we use vendors under contractual terms that prohibit using our or our clients' data to train their public models, and we require human review before AI-assisted output is published or acted on. We do not use AI to make legal or similarly significant automated decisions about you without human involvement.
7. Data Sharing & Disclosure
We do not share your personal information with third parties except in the following circumstances:
- Service Providers and Subprocessors: Vendors who help us operate our business and deliver the Services, including hosting and infrastructure providers, our marketing and messaging platform (Launch365), SMS and email delivery providers, call tracking providers, analytics and advertising platforms, CRM and project management tools, payment processors, and professional advisors. These providers only access what they need to do their job and are bound by confidentiality and data-protection obligations.
- At Your Direction: Third parties you ask us to work with on your behalf, such as your registrar, hosting provider, ad platform, or field-service software vendor.
- Advertising and Analytics Partners: Where you have not opted out, limited identifiers and activity data may be shared with advertising and measurement partners as described in Section 11.
- Business Transfers: If LeadsNearby is acquired or undergoes a change of ownership, merger, financing, or sale of assets, your information may transfer as part of that transaction. We'll notify you if this happens.
- Legal Requirements: When required by law, subpoena, court order, or to protect the rights, property, or safety of LeadsNearby, our clients, or others.
We do not disclose SMS consent or mobile opt-in data to third parties or affiliates for their own marketing purposes under any circumstance. See Section 3.
8. We Do Not Sell Your Data
🚫 LeadsNearby does not sell, rent, or trade your personal information. We have not sold personal information in the preceding 12 months and have no plans to do so. This commitment applies regardless of your state of residence, including California (CCPA/CPRA).
Some U.S. state privacy laws also regulate "sharing" personal information for cross-context behavioral advertising — which can include the use of common advertising cookies and pixels. Where our Site uses those technologies, you may opt out at any time through our cookie tool, your browser settings, or by transmitting a Global Privacy Control signal, which we honor. See Section 11.
9. Storage & Security
- Encryption in Transit: All data transmitted between your browser and our Site is protected with TLS/HTTPS.
- Access Controls: Access to your information is limited to team members and systems that need it to deliver and support the Services. We use role-based access and require multi-factor authentication on administrative systems where supported.
- Credential Handling: Client credentials and API keys are stored in encrypted credential management systems, shared only with personnel who need them, and rotated or revoked at your request or at the end of an engagement. We ask that credentials never be sent by plain email or text.
- Infrastructure Security: Our hosting environment uses firewalling, intrusion detection, malware scanning, patch management, and routine backups.
- Payment Security: Payment information is processed by a PCI-compliant payment processor; we do not store raw card numbers.
- Incident Response: If a breach affecting your personal information occurs, we'll notify affected clients and individuals as required by applicable law and without unreasonable delay.

10. Retention & Deletion
- Client & Project Records: Retained for the duration of the engagement plus a reasonable period afterward for service history, warranty, portfolio, and legal or accounting purposes.
- Website and Hosting Backups: Retained on a rolling schedule consistent with our hosting plan terms, typically not longer than 90 days after they are superseded.
- Message Logs: SMS and email records retained for up to 2 years for compliance purposes.
- Call Recordings and Transcripts: Retained for up to 12 months unless a longer period is required for a dispute or legal obligation.
- Billing Records: Retained up to 7 years in accordance with financial recordkeeping requirements.
- Website and Server Logs: Retained for 90 days for security monitoring.
- Job Applicant Records: Retained for up to 2 years unless you ask us to remove them sooner.
- Client-Controlled Data: Retained and deleted according to our agreement with the client and their instructions.

We'll process verified deletion requests within 30 days, except where we're legally required or contractually obligated to retain certain records (e.g., invoices, contracts, work product).
11. Email Marketing Communications
- Consent: We only send marketing emails to people who've opted in or with whom we have an existing business relationship, as permitted by CAN-SPAM.
- Opt-Out: Every marketing email includes an unsubscribe link, honored within 10 business days per CAN-SPAM.
- Transactional Emails: Proposals, invoices, project notifications, security notices, and service alerts are sent as needed for your account and are not affected by marketing opt-outs.
12. Cookies & Tracking Technologies
- Essential Cookies: Needed for the Site to function (e.g., forms, sessions, security). These can't be disabled.
- Analytics Cookies: Help us understand how visitors use the Site (e.g., Google Analytics, Google Search Console).
- Marketing & Advertising Cookies and Pixels: Used to measure advertising effectiveness and, in some cases, to show you relevant ads on other platforms.
- Chat and Interaction Tools: Our chat widget and similar tools capture the content of chats you initiate and basic technical information so we can respond and maintain a record.
Your choices: You can control cookies through your browser settings or our cookie tool. We honor Global Privacy Control (GPC) and similar browser-based opt-out signals as a valid request to opt out of sale/sharing for the browser transmitting them. Depending on where you live, you may have rights to:

We will take reasonable steps to verify your identity before acting, which may include confirming information already in our records.
Authorized agents: You may use an authorized agent to submit a request on your behalf. We may require written authorization and verification of your identity.
Response times: We respond to California (CCPA/CPRA) requests within 45 days, with one 45-day extension where permitted. Requests under other state laws are handled within the timeframes those laws require.
Appeals: If we decline your request, you may appeal by replying to our decision or emailing privacy@leadsnearby.com with the subject line "Privacy Rights Appeal." We will respond to appeals within 45 days, or within the period required by your state's law.
State-specific rights: Residents of California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with comprehensive privacy laws may have additional or differing rights. We apply these protections to all U.S. residents wherever practical.
Requests about a client's data: If your request concerns information collected through a website, form, chat, or messaging program we operate for one of our clients, see Section 2.
14. Third-Party Websites and Client Websites
Our Site, our proposals, and our portfolio may link to third-party websites, including websites we built or host for our clients. Those sites operate under their own privacy policies, and we are not responsible for their content or practices. We encourage you to review the privacy policy of any site you visit.
15. Children's Privacy
Our Site and Services are not directed to individuals under 18. We do not knowingly collect personal information from children under 18. If we learn we've inadvertently done so, we'll delete it promptly. Contact privacy@leadsnearby.com if you believe we've collected information from a minor.
16. Job Applicants
If you apply for a position with us, we use the information you submit to evaluate your application, communicate with you about the role, verify your background where permitted and with your consent, and comply with employment and equal-opportunity recordkeeping obligations. We do not sell applicant information or use it for marketing.
17. Visitors Outside the United States
Our Site and Services are operated in the United States and intended for a U.S. audience. If you access our Site from outside the United States, you understand that your information will be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your country.
18. Changes to This Policy
We may update this Privacy Policy periodically. When we make material changes, we'll update the "Last Updated" date above and, where appropriate, post a notice on our Site or notify clients directly. Your continued use of the Site or Services after an update constitutes acceptance of the revised policy.
